The Ministry of Economic Development proposes to include all patents for medicines into one pharmaceutical register

The Ministry of Economic Development has proposed to create a register of pharmacologically active substances protected by patents for inventions, the Parlamentskaya Gazeta reports. The corresponding draft law was presented by the agency on September 16 at a meeting with foreign companies within the framework of the second meeting of the executive committee of the Advisory Council on Foreign Investment.

“The register will include basic patents that protect substances as such. At the legislative level, the register will certify the fact that a patent for an invention protects a specific active substance, as well as include details om the owner of the patent rights to the invention. The registration will be based on the international nonproprietary name (INN), which is assigned by WHO to each new drug,” the press service of the ministry noted.

The register, if created, will be under the jurisdiction of the Federal Service for Intellectual Property. Its head, Grigory Ivlev, expressed hope during the meeting that the register will find its use in the field of public procurement, in the judicial protection of rights, and will also contribute to the “timely and legal launch” of generic drugs on the market. In addition, pharmaceutical companies will be able to use data from the register to impose interim measures on manufacturers who violate patent rights, the Ministry of Economic Development noted.

The Ministry of Health, the Ministry of Industry and Trade and the Federal Antimonopoly Service supported the initiative, and it will be sent for interdepartmental approval soon. In their turn, representatives of foreign pharmaceutical companies that are members of the advisory council expressed hope for the launch of the register by the end of this year.

The possibility of introducing the register at the level of the EAEU is being considered.
