Russian President Vladimir Putin signed a law allow the government to use inventions and useful models in the field of health care, as well as to produce drugs without the permission of the patent holder in the interests of national security in emergency cases. The corresponding document is published on the official Internet portal of legal information.
The law specifies that such a right arises “in case of extreme need related to ensuring the defense and security of the state, protecting the life and health of citizens.” The procedure for determining the amount of compensation and the procedure for its payment will be approved by the Government.
Prior to this, the Civil Code allowed the government to use an invention, utility model or industrial design without the consent of the patent holder, notifying him of this as soon as possible and paying him proportionate compensation in the interests of defense and security.
The accompanying documents to the law note that the introduction of such amendments to the Civil Code will make it possible to promptly fill the absence or lack of foreign patented medicines or medical devices in the country.
